Robert F. Kennedy Jr. has filed an emergency appeal with the U.S. Supreme Court seeking to have his name restored to the New York ballot, despite suspending his independent presidential campaign and endorsing Donald Trump.
Kennedy’s name was removed due to residency concerns, as lower courts ruled his claimed New York address was not his fixed residence.
“The address on Kennedy’s petition was and is entirely immaterial – both to voters and to New York,” his attorneys wrote in their appeal.
He contends that the removal unjustly prevents his supporters from voting for him. Justice Sonia Sotomayor has requested a response from New York authorities on the matter.
Earlier this month, Kennedy Jr. had been ordered to remain on Michigan’s ballot for the 2024 election, despite his efforts to withdraw after endorsing former President Donald Trump.
The state’s Supreme Court, with a Democrat-nominated majority, reversed a lower court’s decision, blocking Kennedy’s removal.
Critics, including Republican-nominated justices, warn that his continued presence on the ballot could confuse voters and undermine election integrity.
“This plainly has nothing to do with ballot or election integrity,” said Kennedy’s attorney Aaron Siri. “The aim is precisely the opposite — to have unwitting Michigan voters throw away their votes on a withdrawn candidate.”
Kennedy had similarly sought to be removed from ballots in other battleground states.
